If a family member or close friend has become incapacitated, it may be appropriate for a Guardianship Order or other Order to be obtained from the Court to allow decisions to be made in relation to their finances and/or welfare.

The Adults with Incapacity (Scotland) Act 2000 operates to protect incapacitated individuals to ensure that decisions are made which give full consideration to their own feelings and circumstances. We can advise you at the outset in relation to whether an application for Guardianship is the most appropriate way forward and we can guide you through the application. The Court does require several reports to be submitted by professionals involved with the individual and we work hard to coordinate everyone to ensure that reports are obtained quickly and efficiently,  and to ensure that necessary Orders are granted in the interests of the adult.
